We ask that the fee be paid as follows: The total amount for the first hour will be due at the time of hiring. This fee is a retainer and is non-refundable. If your session goes past the hour, you are responsible for additional payment (billed by the hour). Choice of Law * This Agreement and Release of Liability will be governed by and construed according to the laws of the State of New York applicable to contracts entered into and to be fully performed there. Any legal proceeding brought hereunder shall be limited to the courts of the State of New York, County of Ulster, without regard to its conflict of law principles. In any legal proceeding brought by one party hereunder against the other, the prevailing party will be entitled to recover from the other party its attorneys’ fees and other costs of suit. I agree I disagree Informal Resolution * To expedite resolution and control the cost of any dispute, controversy or claim related to this Agreement, you and Woven Bodies agree to first attempt to negotiate and Dispute informally for at least Thirty (30) days before initiating any meditation, arbitration or court proceeding. Such informal negotiations commence upon written notice from one person to the other. If the dispute is not settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation within 30 days before resorting to arbitration, litigation, or some other dispute resolution procedure.
